1. Overview
FormuNova LLC (“FormuNova”, “we”, “us”) makes private label and custom cosmetics for brands. This policy covers our website (formunova.com) and our Private Label Catalog (catalog.formunova.com), together “our sites”. It applies whether you use one or both. Where something applies to only one, we say so.
In short:
- We collect what you give us (such as your name, email, company, orders, artwork and messages) and some data about how you use our sites.
- We use it to run our sites, handle your requests and orders, and tell you about FormuNova.
- We do not sell your personal information for money. We share it with service providers, and with analytics and advertising platforms such as Google and Meta (section 6).
- You can change your analytics and advertising choices, unsubscribe from marketing email, and ask about your information (sections 4, 5 and 9).
2. Information we collect
What you give us.
- Contact and account details: name, email, company, phone, and billing and shipping address. In the catalog, your password (stored in protected form).
- Orders and requests: sample-pack purchases on the website; carts, SKUs, sample approvals, PO Requests and notes in the catalog; and messages and attachments you send through forms.
- Artwork and other files you upload, including every version.
- Production orders: the billing and payment details needed to confirm, invoice and collect payment. Card payments are handled by our payment processors. We do not store full card numbers.
Collected automatically.
- Device and usage data: IP address, browser and device type, pages viewed, and similar technical data, collected through cookies and similar tools.
- Catalog activity record: while you are signed in to the catalog, we keep our own record of what you view and do, linked to your email. We use it to run and improve the catalog. It is not controlled by Privacy Preferences.
- Saved carts: if you add items to a catalog cart before creating an account, we may save that cart with your email address.
From other sources. Our team may add business contacts to our CRM and email list from lead forms, events or research, and our service providers send us records related to your requests.
3. How we use information
- To run our sites, verify and sign you in, and keep your carts, orders and files.
- To respond to your requests, review artwork, confirm and invoice orders, and follow up.
- To send service emails, such as verification codes and password notices.
- To send marketing emails if you are on our list (section 4).
- To keep our sites secure and prevent fraud and abuse.
- To understand and improve our sites, and to measure our advertising.
- To meet legal obligations and protect our rights.
4. Marketing email
Signing up for our newsletter on the website adds you to our mailing list. Verifying your email to enter the catalog also adds you to it. The verification screen tells you this.
What you do in the catalog may shape which emails you receive. For example, we may note that you signed up, added a product to a cart, or sent a request, so we can send more relevant emails.
You can unsubscribe at any time using the link in any marketing email, or by emailing us. Unsubscribing stops marketing email. It does not close your account, and we may still send service emails.
5. Cookies, analytics and advertising
Catalog. Some storage is strictly necessary to keep you signed in and your cart working. Analytics and advertising are optional and are separate switches in Privacy Preferences (the link at the bottom of every catalog page). When you first continue past the catalog entry screen without a saved choice, both are turned on. You can change either at any time, or choose “Reject optional” to turn both off.
Website. The website does not have a Privacy Preferences panel. To limit cookies and tracking there, use your browser’s controls or an ad blocker.
Our analytics and advertising partners include Google (Analytics, Tag Manager and Ads) and Meta (Pixel and Conversions API), and may include other platforms we start using in the future. See section 6.
6. Who we share information with
We do not sell your personal information for money. We share it as follows:
- Service providers that help us operate: website and catalog hosting, databases and file storage, email delivery, our email marketing and CRM tools, payment and invoicing processors (including Stripe and Intuit QuickBooks), and internal communication and automation tools. They may use your information only to provide services to us.
- Analytics and advertising partners (such as Google and Meta, and other platforms we may use). Their tags collect browsing data on our sites, such as page and product views and cart actions, along with cookie identifiers. When you send a PO Request or a contact request in the catalog, and analytics and advertising are on, our servers also send that event to them. The information sent can include a scrambled (hashed) version of your email address, your IP address and browser details, and, for PO Requests, the estimated order value. A partner can match a hashed email to an account that uses the same email. These companies use the data under their own terms. We do not send your artwork or uploaded files to them.
- Professional advisers, and a buyer or successor if our business is sold or reorganized.
- Authorities and others when the law requires or to protect rights and safety.
Under some US state privacy laws, allowing advertising partners to collect browser data, and sending them a hashed email, so we can measure and improve advertising may count as “sharing” for targeted advertising or a “sale”. The advertising switch in section 5 is your opt-out.
7. How long we keep information
We keep information for as long as we need it for business, legal and tax purposes. This includes accounts, orders, requests, artwork and its versions, invoices, and records in our email and CRM tools. We do not delete this data on a fixed schedule.
Archiving a SKU, discarding an order, or letting a saved cart go inactive hides it from your view, but we keep the record. Our service providers’ backups may keep data for a time after we remove it from live systems. Where the law gives you a right to deletion, see section 9.
8. Security
We use reasonable technical and organizational measures to protect your information, including encryption in transit, protected password storage and access controls. No system is perfectly secure, so we cannot guarantee absolute security.
9. Your choices and rights
Whatever your location, you can:
- ask to see the information we hold about you;
- ask us to correct it (in the catalog you can edit your name, company and phone in My Account);
- ask us to delete or de-identify it where the law gives you that right. We may keep what the law allows or requires us to keep, such as tax and accounting records, records needed to resolve disputes, security records, and a record of your opt-outs;
- unsubscribe from marketing email (section 4);
- opt out of advertising (section 5); and
- not be treated worse for using these rights.
To make a request, email info@formunova.com from the address on your account and tell us what you want. We may need to verify your identity. We will respond within the time the law allows (generally 45 days). You may use an authorized agent, and we may ask for proof they act for you. If we decline a request, you can reply and ask us to reconsider.
10. Children
Our sites are for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, contact us and we will address it.
11. Visitors outside the United States
FormuNova is based in the United States, and we and our providers handle information here. By using our sites from elsewhere, you understand your information will be handled in the United States.
12. Links to other sites
Our sites link to other sites that we do not control. Please read their privacy policies.
13. Changes to this policy
When we change this policy, we will update the date above and post the new version here. For material changes, we will also notify you, for example by email to account holders and our mailing list.
